Filing an International Trademark application under the Madrid Protocol via The Israel Patent Office
Today, due to the joining of Israel to the Madrid Protocol, an Israeli applicant may submit a single trademark application, which can automatically apply in over 90 countries around the world. The filing is done under the "Madrid system", which is operated and managed by WIPO (World Intellectual Property Organization).
The Madrid System facilitates the registration process, and also saves the costs of filing and further maintaining the mark. The international application is based on a national application or a national registration.
The following preliminary conditions must be met and documentation must be provided to the Israel Patent Authority together with the filing fee:
-
Name, address, and incorporation - brand owners must be nationals, domiciled, or have a real and effective industrial or commercial establishment in Israel (entitlement).
-
Representation of the mark (if stylized, a JPG/GIF file of the mark)
-
Classes and detailed list of goods and services
-
Details of the capacity in which the applicant deals with the goods for which the mark is sought (e.g. manufacturer and/or merchant of the specified goods)
-
Details of the Basic Mark - To obtain an international registration, trademark owners must file an international application through the Trademark Office of the Contracting Party - in our case Israel Patent Office (Office of origin) with which they have either filed an application or obtained a registration (basic mark).
-
Details of the priority application if any
-
Original signed Power of Attorney – no legalization or notarization is required
